Neoliberal k\u00fcreselle\u015fmenin di\u011fer sekt\u00f6rlerde yapt\u0131\u011f\u0131 gibi ila\u00e7 alan\u0131nda da devletin yetki ve sorumlulu\u011funu bitirecek, ila\u00e7la ilgili t\u00fcm d\u00fczenleme ve denetleme yetkileri bu s\u00f6zde \u00f6zerk kuruma devredecektir. Devletin ila\u00e7taki t\u00fcm g\u00f6rev ve yetkilerine sahip olacak olan bu kurum, yarg\u0131 denetimi d\u0131\u015f\u0131nda hi\u00e7bir sorumluluk da ta\u015f\u0131mayacak. <\/font><\/p>\n<p style=\"margin: 0cm 0cm 0pt\" class=\"MsoNormal\">\u00a0<\/p>\n<p><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">\u00a0<\/font><strong><font size=\"3\"><font color=\"#000000\"><font face=\"Times New Roman\">YASANIN GEREK\u00c7ELER\u0130 <\/font><\/font><\/font><\/strong><\/p>\n<p style=\"margin: 0cm 0cm 0pt\" class=\"MsoNormal\"><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">Yasan\u0131n gerek\u00e7eleri olarak \u015funlar sunulmaktad\u0131r:<\/font><\/p>\n<p style=\"margin: 0cm 0cm 0pt\" class=\"MsoNormal\"><font size=\"3\"><font color=\"#000000\"><font face=\"Times New Roman\">&#8211; Yeni ila\u00e7lar\u0131n geli\u015ftirilmesi bug\u00fcnk\u00fc \u0130la\u00e7 ve Eczac\u0131l\u0131k Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc yap\u0131s\u0131 ile m\u00fcmk\u00fcn de\u011fildir. Finansal yetersizlik vard\u0131r, yeterli say\u0131da uzman istihdam edilememektedir.<span>\u00a0\u00a0\u00a0\u00a0 <\/span><\/font><\/font><\/font><\/p>\n<p style=\"margin: 0cm 0cm 0pt\" class=\"MsoNormal\"><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">&#8211; \u0130dari ve ekonomik \u00f6zerklik olaca\u011f\u0131 i\u00e7in ve s\u00f6zle\u015fmeli personel \u00e7al\u0131\u015ft\u0131r\u0131laca\u011f\u0131 i\u00e7in i\u015fleyi\u015fte rahatl\u0131k olacakt\u0131r.<\/font><\/p>\n<p style=\"margin: 0cm 0cm 0pt\" class=\"MsoNormal\"><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">&#8211; Avrupa Birli\u011fi bu yasan\u0131n \u00e7\u0131kmas\u0131n\u0131 \u0131srarla istiyor. AB, 2003 ve 2005 y\u0131llar\u0131nda bu taleplerini T\u00fcrkiye\u2019ye bildirmi\u015f, DPT taraf\u0131ndan da ayn\u0131 do\u011frultuda siyasi iktidara \u00f6neride bulunulmu\u015ftur.<\/font><\/p>\n<p style=\"margin: 0cm 0cm 0pt\" class=\"MsoNormal\"><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">&#8211; \u0130la\u00e7 sekt\u00f6r\u00fcn\u00fc ve ila\u00e7lar\u0131 denetleyip y\u00f6nlendirecek bilimsel standart bug\u00fcn Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131\u2019nda yoktur.<\/font><\/p>\n<p style=\"margin: 0cm 0cm 0pt\" class=\"MsoNormal\"><font size=\"3\"><font color=\"#000000\"><font face=\"Times New Roman\">&#8211; \u0130la\u00e7, bitkisel ila\u00e7lar, g\u0131da takviyeleri ve medikal \u00fcr\u00fcnler hepsi tek bir kurum taraf\u0131ndan d\u00fczenlenecek ve denetlenecek. Bilindi\u011fi gibi bitkisel ila\u00e7lar ve g\u0131da takviyelerinin ruhsatlar\u0131 Tar\u0131m ve K\u00f6yi\u015fleri Bakanl\u0131\u011f\u0131\u2019nca verilmekteydi. Bu durum yetki karma\u015fas\u0131 ve denetim zafiyetine yol a\u00e7maktad\u0131r. <span>\u00a0<\/span><\/font><\/font><\/font><\/p>\n<p style=\"margin: 0cm 0cm 0pt\" class=\"MsoNormal\"><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">&#8211; Kurum hayata ge\u00e7erse, ila\u00e7 ruhsatlar\u0131 \u00e7ok daha k\u0131sa s\u00fcrede verilecek. Bug\u00fcn en ge\u00e7 210 g\u00fcn olan s\u00fcre daha da k\u0131salacak.<\/font><\/p>\n<p style=\"margin: 0cm 0cm 0pt\" class=\"MsoNormal\"><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">&#8211; \u0130la\u00e7 sekt\u00f6r\u00fc siyasilerin etki ve m\u00fcdahalelerinin d\u0131\u015f\u0131na \u00e7\u0131kar\u0131lacak. <\/font><\/p>\n<p style=\"margin: 0cm 0cm 0pt\" class=\"MsoNormal\">\u00a0<\/p>\n<p><strong><font size=\"3\"><font color=\"#000000\"><font face=\"Times New Roman\">KURUM G\u00d6REV VE YETK\u0130LER\u0130<\/font><\/font><\/font><\/strong> <\/p>\n<p><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">Onlarca madde halinde yaz\u0131lan yetkileri \u00f6zetlemek gerekirse, Kurum;<\/font><\/p>\n<ul>\n<li class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; tab-stops: list 36.0pt\"><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">T\u00fcrkiye\u2019de ila\u00e7la ilgili t\u00fcm mevzuat\u0131 d\u00fczenleyecek. <\/font><\/li>\n<li class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; tab-stops: list 36.0pt\"><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">\u0130la\u00e7lar\u0131n imalat\u0131n\u0131, ithalat\u0131n\u0131, ruhsatland\u0131r\u0131lmas\u0131n\u0131, fiyat\u0131n\u0131, da\u011f\u0131t\u0131m\u0131n\u0131 ve kullan\u0131m\u0131n\u0131 belirleyecek, bu s\u00fcre\u00e7lere dair usul ve esaslar\u0131 belirleyecek. <\/font><\/li>\n<li class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; tab-stops: list 36.0pt\"><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">\u0130la\u00e7 haline gelmemi\u015f kimyasallar\u0131n, T\u00fcrkiye\u2019de insanlar \u00fczerinde yap\u0131lacak olan klinik ara\u015ft\u0131rmalar\u0131n usul ve esaslar\u0131n\u0131 belirleyecek, izinlerini verecek ve denetleyecek. <\/font><\/li>\n<li class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; tab-stops: list 36.0pt\"><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">\u0130la\u00e7 ve di\u011fer t\u0131bbi \u00fcr\u00fcn ve medikallerin \u00fcretim yerlerini denetleyip pazar denetimlerini yapacak.<\/font><\/li>\n<li class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; tab-stops: list 36.0pt\"><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">\u0130la\u00e7larla ilgili uluslararas\u0131 s\u00f6zle\u015fmelerde, toplant\u0131larda, politikalar\u0131 belirlemek \u00fczere bakanl\u0131\u011fa dan\u0131\u015fmanl\u0131k yapacak ve \u00f6nerilerde bulunacak. <\/font><\/li>\n<\/ul>\n<p style=\"margin: 0cm 0cm 0pt\" class=\"MsoNormal\"><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">B\u00fct\u00fcn bu g\u00f6rev ve yetkilere sahip olan kurum; b\u00fcrokratik ve siyasi herhangi bir sorumlulu\u011fa ise sahip olmayacak. Oysa ila\u00e7 gibi toplum sa\u011fl\u0131\u011f\u0131n\u0131 ilgilendiren sosyal bir \u00fcr\u00fcnde, devletin sorumluluktan vazge\u00e7mesi s\u00f6z konusu olmamal\u0131d\u0131r. Yetki-sorumluluk dengesi devlet olman\u0131n temelinde vard\u0131r.<\/font><\/p>\n<p style=\"margin: 0cm 0cm 0pt\" class=\"MsoNormal\">\u00a0<\/p>\n<p><strong><font size=\"3\"><font color=\"#000000\"><font face=\"Times New Roman\">\u00d6rnek 1- Roche skandal\u0131 <\/font><\/font><\/font><\/strong><\/p>\n<p><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">Roche skandal\u0131 diye tarihe ge\u00e7en iki y\u0131l \u00f6nceki olayda \u0130la\u00e7 Eczac\u0131l\u0131k Genel M\u00fcd\u00fcr\u00fc dahil Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131\u2019ndan ve SSK Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc\u2019nden bir\u00e7ok b\u00fcrokrat yarg\u0131lanmakta. S\u00f6zkonusu ila\u00e7 kurumu olsayd\u0131 b\u00f6yle bir olay ortaya \u00e7\u0131kar\u0131lamazd\u0131, dolay\u0131s\u0131yla bu dava da a\u00e7\u0131lamazd\u0131. \u00c7\u00fcnk\u00fc orada \u00e7al\u0131\u015fanlar\u0131n b\u00f6yle bir devlet b\u00fcrokrat\u0131 sorumlulu\u011fu olmayacakt\u0131r. Keza kurum ba\u015fkan\u0131n\u0131n da Sa\u011fl\u0131k Bakan\u0131 gibi siyasi bir sorumlulu\u011fu olamayacakt\u0131r.\u00a0<\/font><\/p>\n<p><strong><font size=\"3\"><font color=\"#000000\"><font face=\"Times New Roman\">\u00d6rnek 2- Biyoe\u015fde\u011ferlik skandal\u0131<\/font><\/font><\/font><\/strong> <\/p>\n<p><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">2005 y\u0131l\u0131nda Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131\u2019nda akademisyenlerden olu\u015fan Biyoe\u015fde\u011fer \u0130la\u00e7 Komisyonu \u00fcyeleri istifa ettiler. \u00c7\u00fcnk\u00fc bir\u00e7ok ila\u00e7 firmas\u0131n\u0131n, ila\u00e7lar\u0131na yurtd\u0131\u015f\u0131nda yapt\u0131rm\u0131\u015f olduklar\u0131 biyoe\u015fde\u011ferlik raporlar\u0131n\u0131n sahte oldu\u011fu bu komisyon taraf\u0131ndan tespit edilmi\u015fti. Yap\u0131lan tespite ra\u011fmen gereken i\u015flem yap\u0131lmad\u0131\u011f\u0131 i\u00e7in istifa etmeye karar vermi\u015flerdi. Sonu\u00e7ta o zamanki \u0130la\u00e7 Eczac\u0131l\u0131k Genel M\u00fcd\u00fcr\u00fc de istifa etmek zorunda kald\u0131. \u00d6zerk bir kurumda ve hele finans kaynaklar\u0131 ba\u011f\u0131\u015f yoluyla ila\u00e7 sanayi taraf\u0131ndan kar\u015f\u0131lanan bir kurumda b\u00f6yle bir sahtecili\u011fin ortaya \u00e7\u0131kar\u0131lmas\u0131 bana g\u00f6re \u00e7ok olas\u0131 de\u011fildir.\u00a0<\/font><\/p>\n<p><strong><font size=\"3\"><font color=\"#000000\"><font face=\"Times New Roman\">KURUMUN KAYNAKLARI<\/font><\/font><\/font><\/strong> <\/p>\n<p><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">Kurumun b\u00fct\u00e7esi d\u00f6ner sermayeye dayan\u0131yor. D\u00f6ner sermaye kaynaklar\u0131na gelince hazineden al\u0131nan pay d\u0131\u015f\u0131nda temel gelirleri:<\/font><\/p>\n<p><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">&#8211; Kurumun verece\u011fi hizmetler kar\u015f\u0131l\u0131\u011f\u0131 al\u0131nacak olan har\u00e7lar,<\/font><\/p>\n<p><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">&#8211; \u0130la\u00e7 ve t\u0131bbi \u00fcr\u00fcn olarak \u00fcretilecek veya ithal edilecek t\u00fcm \u00fcr\u00fcnlerden %0,5\u2019i ge\u00e7memek \u00fczere al\u0131nacak bedel. <\/font><\/p>\n<p><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">&#8211; Ger\u00e7ek ve t\u00fczel ki\u015filerden al\u0131nacak olan ba\u011f\u0131\u015flar.<\/font><\/p>\n<p><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">G\u00f6r\u00fcld\u00fc\u011f\u00fc gibi kurumun d\u00f6ner sermayesini olu\u015fturan kaynaklar b\u00fcy\u00fck oranda; d\u00fczenlemek ve denetlemekle y\u00fck\u00fcml\u00fc oldu\u011fu ila\u00e7 sanayisi taraf\u0131ndan kar\u015f\u0131lanacakt\u0131r. Bu durum etik kayg\u0131lar\u0131n \u00f6tesinde, istismara a\u00e7\u0131k, dolay\u0131s\u0131yla halk sa\u011fl\u0131\u011f\u0131n\u0131 tehlikeye atabilecek bir durumdur.<\/font><\/p>\n<p><strong><font size=\"3\"><font color=\"#000000\"><font face=\"Times New Roman\">GER\u00c7EKTE BU TASLA\u011eIN AMA\u00c7LARI\u2026<\/font><\/font><\/font><\/strong> <\/p>\n<p><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">a) \u0130lac\u0131 kamu denetiminden \u00e7\u0131karmak,<\/font><\/p>\n<p><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">b) \u0130lac\u0131 eczac\u0131dan koparmak, soyutlamak, yabanc\u0131la\u015ft\u0131rmak,<\/font><\/p>\n<p><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">c) T\u00fcrkiye\u2019de pazar\u0131n y\u00fczde 70\u2019i yabanc\u0131lar\u0131n eline ge\u00e7mi\u015f olan ila\u00e7 sermayesinin i\u015fini kolayla\u015ft\u0131rmak.<\/font><\/p>\n<p><strong><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">\u0130la\u00e7 kamu denetiminden nas\u0131l \u00e7\u0131kar\u0131l\u0131yor?<\/font><\/strong><\/p>\n<p><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">Yasa;<\/font><\/p>\n<p><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">\u2022 Sa\u011fl\u0131k Hizmetleri Temel Kanunu\u2019nun 3\/k bendini kald\u0131r\u0131yor. B\u00f6ylece Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131\u2019n\u0131n ila\u00e7la hi\u00e7bir ili\u015fkisi kalm\u0131yor.<\/font><\/p>\n<p><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">\u2022 3959 say\u0131l\u0131 H\u0131fz\u0131ss\u0131hha Kanunu\u2019nun 2\/d maddesini kald\u0131r\u0131yor. B\u00f6ylece T\u00fcrkiye\u2019de ila\u00e7lar\u0131n s\u00fcrekli yap\u0131lmas\u0131 gereken analiz ve kontrollerinde devlet g\u00f6revi sona eriyor. Bu taslak yasala\u015f\u0131rsa bu t\u00fcr rutin kontrol ve analizler kamu kurumlar\u0131nda ve \u00f6zel kurumlarda, her yerde yap\u0131labilecek. Peki biz bunlara nas\u0131l g\u00fcvenece\u011fiz? Kimseye kar\u015f\u0131 sorumlulu\u011fu olmayan b\u00f6yle bir kurum taraf\u0131ndan \u00f6zel merkezlerde yapt\u0131r\u0131lacak analiz ve kontroller ne derece sa\u011fl\u0131kl\u0131 olacakt\u0131r?<\/font><\/p>\n<p><strong><font size=\"3\"><font color=\"#000000\"><font face=\"Times New Roman\">\u0130lac\u0131 eczac\u0131dan nas\u0131l koparacaklar?<\/font><\/font><\/font><\/strong> <\/p>\n<p><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">\u2022 Madde 28-a: 13.12.1983 tarihli ve 181 say\u0131l\u0131 Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131\u2019n\u0131n Te\u015fkilat ve G\u00f6revleri Hakk\u0131ndaki KHK\u2019nin 11\u2019inci maddesi ve ayn\u0131 KHK\u2019nin 10\/c bendi kalk\u0131yor. 11\u2019inci maddenin kalkmas\u0131yla \u0130la\u00e7 ve Eczac\u0131l\u0131k Genel M\u00fcd\u00fcr\u00fcn\u00fcn g\u00f6revlerini belirleyen ve eczanelerin a\u00e7\u0131l\u0131\u015f\u0131n\u0131 d\u00fczenleyen mevzuat kalkm\u0131\u015f oluyor. Yani ila\u00e7la eczac\u0131 birbirinden ayr\u0131lm\u0131\u015f oluyor.<\/font><\/p>\n<p><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">\u2022 1262 say\u0131l\u0131 yasa, tasla\u011f\u0131n ilk halinde hepten kald\u0131r\u0131l\u0131yordu, ikinci halindeyse i\u015flevsiz hale getiriliyor. \u00c7\u00fcnk\u00fc ila\u00e7 yasas\u0131n\u0131 y\u00fcr\u00fctecek, uygulayacak olan Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131\u2019yla ili\u015fi\u011fi kesilmi\u015f, \u0130la\u00e7 ve Eczac\u0131l\u0131k Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc iptal edilmi\u015fti. \u0130\u015fte bu nedenle 1262 say\u0131l\u0131 yasa dursa bile kanunu y\u00fcr\u00fctecek bakanl\u0131k ortada olmayacak.<\/font><\/p>\n<p><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">\u2022 767 say\u0131l\u0131 Kodeks Yasas\u0131\u2019n\u0131, 5324 say\u0131l\u0131 Kozmetik Yasas\u0131\u2019n\u0131 kald\u0131r\u0131yor. Ne demek oluyor bu? \u0130la\u00e7 ve eczac\u0131l\u0131k mesleki fonksiyonlar\u0131n\u0131 yok etmek.<\/font><\/p>\n<p><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">\u2022 Kurum yasa tasla\u011f\u0131n\u0131n ba\u015f\u0131ndan sonuna kadar eczac\u0131 ve eczane laf\u0131 asla ge\u00e7miyor ve bu bilin\u00e7li, kurgulu bir yakla\u015f\u0131m. Bak\u0131n\u0131z: Madde 3\u2019\u00fcn 2-b\u2019de \u015f\u00f6yle diyor: \u201c\u0130la\u00e7lar\u0131n imalat yerleri, \u015fartlar\u0131 ile sat\u0131\u015f ve da\u011f\u0131t\u0131m yerleri ile ilgili mevzuat\u0131 belirlemek\u201d kurumun g\u00f6rev tan\u0131mlar\u0131 aras\u0131nda yer al\u0131yor. Dikkat edilirse \u201cila\u00e7 sat\u0131\u015f yerleri\u201dnden s\u00f6z ediyor, ama dili var\u0131p da \u201ceczane\u201d diyemiyor.<\/font><\/p>\n<p><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">\u2022 Madde 10\u2019da, Kurumun denetim daire ba\u015fkanl\u0131\u011f\u0131n\u0131n g\u00f6revleri aras\u0131nda \u201cila\u00e7lar\u0131n \u00fcretim yerlerini denetlemek, ila\u00e7lar\u0131n toptan da\u011f\u0131t\u0131m yerlerini denetlemek\u201d ifade ediliyor. Eczane gene yok!<\/font><\/p>\n<p><strong><font size=\"3\"><font color=\"#000000\"><font face=\"Times New Roman\">\u0130la\u00e7 sermayesinin i\u015fi nas\u0131l kolayla\u015ft\u0131r\u0131l\u0131r?<\/font><\/font><\/font><\/strong> <\/p>\n<p><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">\u2022 T\u00fcrkiye ila\u00e7 pazar\u0131n\u0131 b\u00fcy\u00fctmekle; ki\u015fi ba\u015f\u0131na ila\u00e7 harcamas\u0131n\u0131 250 dolara, toplam ila\u00e7 pazar\u0131n\u0131 16 milyar dolara \u00e7\u0131karmakla,<\/font><\/p>\n<p><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">\u2022 \u0130la\u00e7 \u00fczerinden, insan sa\u011fl\u0131\u011f\u0131 \u00fczerinden daha \u00e7ok rant elde etmenin ko\u015fullar\u0131n\u0131 sa\u011flamakla\u2026<\/font><\/p>\n<p><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">\u2022 \u0130la\u00e7 konusunda bir bakanl\u0131k g\u00fcc\u00fcyle donat\u0131lm\u0131\u015f olan kurum, ila\u00e7 sermayesinin T\u00fcrkiye\u2019deki her sorununu \u00e7\u00f6zmeye yetkili olacak. Ruhsatland\u0131rma, fiyatland\u0131rma, klinik ara\u015ft\u0131rmalar, ila\u00e7lar\u0131n s\u0131n\u0131fland\u0131r\u0131lmas\u0131, ila\u00e7lar\u0131n kontrol ve analizi, geri \u00e7ekmeler, s\u00fcratle halledilecektir. Yani \u0130la\u00e7 ve Eczac\u0131l\u0131k Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc\u2019n\u00fcn i\u015flevi tamamen kurumda olacakt\u0131r.<\/font><\/p>\n<p><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">\u2022 Bu kurum yabanc\u0131 uzman \u00e7al\u0131\u015ft\u0131racakt\u0131r. Bu yabanc\u0131 uzmanlar kurum i\u00e7inde T\u00fcrkiye\u2019de ila\u00e7 mevzuat\u0131n\u0131 olu\u015fturacaklar.<\/font><\/p>\n<p><font size=\"3\"><font color=\"#000000\"><font face=\"Times New Roman\">\u2022 \u0130ngiltere\u2019den bir \u00f6rnek: \u0130ngiltere \u0130la\u00e7 Ajans\u0131 raporunda, insan kaynaklar\u0131 olarak ila\u00e7 end\u00fcstrisinden kuruma uzman transfer edildi\u011fi ve yine \u0130la\u00e7 Kurumundan da ila\u00e7 end\u00fcstrisinde emekli olan personelin istihdam edildi\u011fi \u00f6vg\u00fcyle yaz\u0131l\u0131yordu. Yani kurum ile ila\u00e7 sanayisi kar\u015f\u0131l\u0131kl\u0131 bir personel al\u0131\u015fveri\u015finde bulunuyor. Bunun sonu\u00e7lar\u0131n\u0131 d\u00fc\u015f\u00fcnebiliyor musunuz? Kim kime hizmet edecek? T\u00fcrkiye\u2019ye bakt\u0131\u011f\u0131m\u0131zda, daha bu yasa \u00e7\u0131kmadan Bakanl\u0131ktan emekli olan \u0130la\u00e7 ve Eczac\u0131l\u0131k Genel M\u00fcd\u00fcrlerinin hemen hepsinin sanayide i\u015f buldu\u011funu g\u00f6r\u00fcyoruz. En son Sosyal G\u00fcvenlik Kurumu Ba\u015fkan\u0131 yabanc\u0131 bir ila\u00e7 firmas\u0131na genel m\u00fcd\u00fcr oldu.<\/font><\/font><\/font><\/p>\n<p><strong><font size=\"3\"><font color=\"#000000\"><font face=\"Times New Roman\">ANAYASAYA AYKIRIDIR<\/font><\/font><\/font><\/strong> <\/p>\n<p><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">\u00c7\u00fcnk\u00fc toplum sa\u011fl\u0131\u011f\u0131n\u0131 ve \u00fclkenin sa\u011fl\u0131k konusundaki g\u00fcvencesini ilgilendiren, hayati bir \u00fcr\u00fcn olan ila\u00e7 konusunda at\u0131lacak t\u00fcm ad\u0131mlar\u0131 Meclis denetiminin d\u0131\u015f\u0131na \u00e7\u0131karmaktad\u0131r.<\/font><\/p>\n<p><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">a) Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131\u2019n\u0131n yetki ve sorumlulu\u011fu ortadan kalk\u0131yor.<\/font><\/p>\n<p><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">b) Yetkinin devredildi\u011fi \u0130la\u00e7 Kurumu ise hi\u00e7 kimseye kar\u015f\u0131 sorumlulu\u011fu olmayan ama bir Bakanl\u0131k gibi yetkilerle donat\u0131lm\u0131\u015f bir kurum. Bu \u00fclkede ila\u00e7tan sorumlu kimse kalm\u0131yor art\u0131k.<\/font><\/p>\n<p><font face=\"Times New Roman\" size=\"3\" color=\"#000000\">Taslak Madde 28 (d) ile Sa\u011fl\u0131k Hizmetleri Temel Kanunu\u2019nun 3\/k maddesi kald\u0131r\u0131l\u0131yor.
